‘Article 19(2) of Constitution के अलावा देश के नागरिकों पर नहीं लगाए जा सकते प्रतिबंध’, सुप्रीम कोर्ट ने कहा- अपने बयानों के लिए खुद नेता जिम्मेदार

सुप्रीम कोर्ट (Supreme Court) ने मंगलवार को सार्वजनिक पदाधिकारियों की अभिव्यक्ति की स्वतंत्रता पर किसी भी अतिरिक्त प्रतिबंध की मांग को खारिज कर दिया। बार एंड बेंची की रिपोर्ट के मुताबिक, सुप्रीम कोर्ट ने कहा कि मंत्रियों, सांसदों और विधायकों को संविधान के अनुच्छेद 19 (1) (ए) के तहत अन्य नागरिकों के समान अभिव्यक्ति की स्वतंत्रता का समान अधिकार प्राप्त है।

सुप्रीम कोर्ट ने कहा कि संविधान के अनुच्छेद 19(2) के तहत निर्धारित प्रतिबंधों के अलावा कोई भी अतिरिक्त प्रतिबंध भाषण (speech) और अभिव्यक्ति की स्वतंत्रता के अधिकार के तहत नागरिक पर नहीं लगाया जा सकता है। सुप्रीम कोर्ट ने आगे कहा कि किसी भी मंत्री द्वारा दिए गए बयान को लेकर अप्रत्यक्ष रूप से सरकार के लिए जिम्मेदार नहीं ठहराया जा सकता है। पांच जजों की बेंच ने कहा कि किसी भी बयान के लिए मंत्री खुद जिम्मेदार है।

कोर्ट ने कहा, “अनुच्छेद 19 (2) के तहत नहीं पाए जाने वाले अतिरिक्त प्रतिबंध अनुच्छेद 19 (1) (ए) के आधार पर नहीं लगाए जा सकते… फ्री स्पीच को प्रतिबंधित करने के लिए अनुच्छेद 19 (2) में उल्लिखित आधार संपूर्ण हैं। अनुच्छेद 19(2) में नहीं पाए गए अतिरिक्त प्रतिबंधों को 19(1)(ए) के तहत अधिकार के प्रयोग पर नहीं लगाया जा सकता है।”
सुप्रीम कोर्ट ने यह फैसला सरकार से जुड़े पदाधिकारियों के भाषण की स्वतंत्रता के दायरे और नागरिकों के व्यापक हित में उनके अधिकार और उनके जीवन और व्यक्तिगत स्वतंत्रता के अधिकार पर अधिक प्रतिबंध लगाने से संबंधित कई दलीलों पर सुनवाई के बाद फैसला सुनाया। सुप्रीम कोर्ट ने यह भी कहा कि सरकार या उसके मामलों से संबंधित मंत्री द्वारा दिए गए बयान को अप्रत्यक्ष रूप से सरकार के लिए जिम्मेदार नहीं ठहराया जा सकता है।
सुप्रीम कोर्ट की बेंच ने कहा, “नागरिकों के अधिकारों के विपरीत एक मंत्री द्वारा दिया गया बयान मात्र एक संवैधानिक अपकृत्य (constitutional tort)नहीं होता है, लेकिन यदि यह एक सरकारी अधिकारी द्वारा चूक या अपराध का कारण बनता है तो यह एक संवैधानिक अपकृत्य है।” बार एंड बेंच के अनुसार, जस्टिस बीवी नागरत्न ने एक अलग फैसले में कहा कि भाषण और अभिव्यक्ति की स्वतंत्रता एक बहुत आवश्यक अधिकार है ताकि नागरिकों को शासन के बारे में अच्छी तरह से सूचित और शिक्षित किया जा सके, यह हेट स्पीच में नहीं बदल सकता।

The Supreme Court on Tuesday rejected the demand for any additional restrictions on the freedom of expression of public functionaries. According to the Bar and Bench report, the Supreme Court held that Ministers, MPs and MLAs enjoy the same right to freedom of expression as other citizens under Article 19 (1) (a) of the Constitution.

The Supreme Court held that apart from the restrictions prescribed under Article 19(2) of the Constitution, no additional restrictions can be imposed on a citizen under the right to freedom of speech and expression. The Supreme Court further said that the government cannot be held responsible indirectly for the statements made by any minister. The five-judge bench said that the minister himself is responsible for any statement.

The Court said, “Additional restrictions not found under Article 19(2) cannot be imposed on the basis of Article 19(1)(a)… The grounds mentioned in Article 19(2) for restricting free speech are exhaustive Huh. Additional restrictions not found in Article 19(2) cannot be imposed on the exercise of the right under 19(1)(a).”
The Supreme Court gave this verdict after hearing several pleas regarding the scope of freedom of speech of government functionaries and their rights in the larger interest of citizens and imposing more restrictions on their right to life and personal liberty. The Supreme Court also held that statements made by a minister relating to the government or its affairs cannot be indirectly attributed to the government.
The Supreme Court bench observed, “A statement made by a minister contrary to the rights of citizens is not merely a constitutional tort, but if it constitutes an omission or commission of an offense by a public official, it is a constitutional tort.” Is.” According to Bar & Bench, Justice BV Nagaratna in a separate judgment said that freedom of speech and expression is a very essential right so that citizens are well informed and educated about governance, it cannot turn into hate speech .
