हेमंत सोरेन की जमानत याचिका की सुनवाई आज फिर झारखंड हाईकोर्ट में होगी।
जमीन घोटाले और मनी लॉन्ड्रिंग मामले में शामिल पूर्व सीएम हेमंत सोरेन की जमानत याचिका की सुनवाई आज फिर होगी। बुधवार को चली बहस दो घंटे से अधिक चली, लेकिन सुनवाई अब तक पूरी नहीं हुई।
रांची में, झारखंड हाइकोर्ट के न्यायाधीश रंगन मुखोपाध्याय की अदालत ने जमीन घोटाले और मनी लॉन्ड्रिंग मामले में आरोपी पूर्व मुख्यमंत्री हेमंत सोरेन की जमानत याचिका को गुरुवार को पुनः सुनवाई के लिए निर्धारित किया। बुधवार को दो घंटे से अधिक चली बहस में अदालत ने सुनवाई पूरी नहीं की, जिसके बाद 13 मई को आज की तारीख के लिए मामले की अगली सुनवाई का निर्धारण किया।
इससे पहले बुधवार को हुई सुनवाई में ईडी की ओर से वरीय अधिवक्ता एसवी राजू ने वीडियो कॉन्फ्रेंसिंग से पक्ष रखते हुए अदालत को बताया कि बड़गाई अंचल की 8.86 एकड़ जमीन पर पूर्व मुख्यमंत्री हेमंत सोरेन का ही कब्जा है. कब्जा के संबंध में बड़गाई अंचलाधिकारी (सीअो), राजस्व उप निरीक्षक भानु प्रताप प्रसाद तथा सीएम के प्रेस सलाहकार रहे अभिषेक प्रसाद उर्फ पिंटू ने बयान देकर इसकी पुष्टि की है.
हेमंत सोरेन के निर्देशानुसार ही जमीन का सत्यापन हुआ।
ईडी के वकील ने दावा किया कि अभिषेक प्रसाद ने बताया है कि हेमंत सोरेन के निर्देशानुसार, उन्होंने सीएमओ में कार्यरत उदय शंकर को बरियातू करने के लिए विवादित जमीन का सत्यापन कराने का निर्देश दिया था। उदय शंकर ने तत्कालीन सीओ मनोज कुमार को इसे करने के लिए कहा। मनोज कुमार ने फिर राजस्व उप निरीक्षक भानु प्रताप प्रसाद को सीएमओ के निर्देश के आधार पर मामले का परीक्षण करने के निर्देश दिए।
कपिल सिब्बल बोले- बड़गाई अंचल की जमीन भुईंहरी प्रकृति की
इससे पहले 10 जून को हुई सुनवाई में हेमंत सोरेन के वकील कपिल सिब्बल ने कहा कि मेरे मुवक्किल पर लगे रहे आरोप बेबुनियाद है. उन्होंने अदालत को बताया था कि बड़गाई की 8.86 एकड़ जमीन भुईंहरी प्रकृति की जमीन है. उक्त जमीन ट्रांसफर भी नहीं हो सकती है. जमीन का मालिकाना अधिकार हेमंत सोरेन के पास नहीं है. जमीन के किसी दस्तावेज में उनका नाम भी नहीं है. यह जमीन विवाद का मामला है, आपराधिक मामला भी नहीं है. पीएमएलए के शेड्यूल ऑफेंस में जमीन पर कब्जे का मामला नहीं आता है.
हेमंत सोरेन 31 जनवरी 2024 से जेल में हैं बंद
उल्लेखनीय है कि पूर्व मुख्यमंत्री हेमंत सोरेन ने जमानत याचिका दायर की है. वह 31 जनवरी 2024 से जेल में बंद हैं. मामले में इडी द्वारा हेमंत सोरेन सहित अन्य आरोपियों के खिलाफ चार्जशीट भी दायर की गयी है.

In Ranchi, the court of Jharkhand High Court Justice Rangan Mukhopadhyay scheduled the bail plea of former chief minister Hemant Soren, accused in a land scam and money laundering case, for rehearing on Thursday. The court did not complete the hearing in arguments that lasted for more than two hours on Wednesday, after which it scheduled the next hearing of the case for today, May 13.
Earlier, in the hearing held on Wednesday, ED’s senior advocate SV Raju, while presenting his side through video conferencing, told the court that 8.86 acres of land in Badgai area is in the possession of former Chief Minister Hemant Soren. Regarding the capture, Bargai Circle Officer (CO), Revenue Sub Inspector Bhanu Pratap Prasad and CM’s press advisor Abhishek Prasad alias Pintu have confirmed this by giving statements.
The land was verified as per the instructions of Hemant Soren.
ED’s lawyer claimed that Abhishek Prasad has told that as per the instructions of Hemant Soren, he had instructed Uday Shankar working in CMO to get the disputed land verified for Bariatu. Uday Shankar asked the then CO Manoj Kumar to do it. Manoj Kumar then directed Revenue Sub Inspector Bhanu Pratap Prasad to investigate the case based on the instructions of the CMO.
Kapil Sibal said – The land of Badgai region is of earthy nature.
Earlier, in the hearing held on June 10, Hemant Soren’s lawyer Kapil Sibal said that the allegations against his client are baseless. He had told the court that 8.86 acres of land of Badgai is land of dry nature. The said land also cannot be transferred. Hemant Soren does not have ownership rights of the land. His name is not there in any land document. This is a land dispute case, not even a criminal case. The matter of possession of land does not come under the schedule offense of PMLA.
Hemant Soren is in jail from 31 January 2024
It is noteworthy that former Chief Minister Hemant Soren has filed a bail petition. He is in jail since 31 January 2024. Chargesheet has also been filed by ED against Hemant Soren and other accused in the case.
