विषयः जनसंख्या विस्फोट एवं जनसांख्यिकीय असंतुलन के कारण भारत राष्ट्र के समक्ष उत्पन्न चुनौतियों के समाधान के लिए अविलंब जनसंख्या नियंत्रण कानून बनाकर लागू करने के संबंध में।

आदरणीय महोदय,
भारत की संस्कृति और अखंडता को अक्षुण्ण रखने की कामना करने वाले देशभर के लोग जनसंख्या में वर्गीय असंतुलन को लेकर अत्यंत चिंतित हैं। सबका मानना है कि पूर्व में धार्मिक आधार पर विभाजित हो चुके देश में कुल प्रजनन दर (TFR) में दर्शाई जा रही तथाकथित गिरावट के बावजूद विभिन्न वर्गों के बीच आबादी का सामाजिक संतुलन लगातार बिगड़ते जाना एक खतरनाक स्थिति है। यह असंतुलन भविष्य में देश के ताने-बाने के लिए अत्यंत विनाशकारी साबित हो सकता है।

जनसंख्या विस्फोट एवं जनसांख्यिकीय असंतुलन की समस्या पर कुशल एवं प्रभावी नियंत्रण के लिए जनसंख्या नियंत्रण कानून की मांग को लेकर विगत 9 वर्षों से अधिक समय से “जनसंख्या समाधान फाउन्डेशन” के तत्वावधान में सरायकेला खरसावां जिले सहित देशभर में हजारों छोटी-बड़ी सभाएं, बड़ी-बड़ी रैलियां, पदयात्राएं और रथयात्राएं आयोजित की गई हैं। माननीय राष्ट्रपति जी से भेंट करके विषय का प्रस्तुतिकरण देने एवं सांसद-संवाद कार्यक्रमों सहित देश के अधिकांश जिलों के संगठन कार्यकर्ताओं द्वारा प्रत्येक वर्ष विश्व जनसंख्या दिवस सहित अन्य अवसरों पर भी जिलाधिकारियों के माध्यम से माननीय प्रधानमंत्री जी के नाम ज्ञापन सौंपे जाते रहे हैं। वर्तमान में संगठन द्वारा उपरोक्त कानून पर आम लोगों का समर्थन प्राप्त करने के उद्देश्य से देशभर में हस्ताक्षर अभियान चलाया जा रहा है ।

राष्ट्र के समक्ष उपस्थित अनेक प्रकार की चुनौतियों के समाधान तथा सभी नागरिकों के लिए सुरक्षित, समर्थ और खुशहाल भारत बनाने के लक्ष्य की प्राप्ति के लिए निरंतर प्रयासरत रहने और राष्ट्रीय महत्व के अन्य महत्वपूर्ण कार्यों में अपनी व्यस्तता के कारण सम्भवतः आप जनसांख्यिकीय असंतुलन की समस्या की ओर उतना ध्यान नहीं दे पा रहे हैं, अन्यथा पूर्व में देश को विभाजित कर चुकी और भविष्य में पुनः ऐसा होने की संभावना की चेतावनी दे रही इस गंभीर समस्या के समाधान के लिए अवश्य ही आपके द्वारा अब तक ठोस कदम उठा लिया गया होता।

जनसंख्या विषयक हमारे अभियान को भारत सरकार के एक वरिष्ठ मंत्री तथा देश के एक राष्ट्रवादी संगठन के कुछ महत्वपूर्ण सदस्यों का अनवरत सहयोग मिलता रहा है। वर्ष 2018 में हमें जनसंख्या नियंत्रण कानून विषयक हमारे मांग-पत्र पर 125 सांसदों का लिखित समर्थन भी प्राप्त हुआ जिसे हमारे संगठन और 4 सांसदों के संयुक्त प्रतिनिधिमंडल द्वारा 9 अगस्त 2018 को तत्कालीन माननीय राष्ट्रपति जी को उनसे विषय पर विस्तृत चर्चा के उपरान्त सौंपा गया। इस सबके बावजूद इतने गंभीर विषय पर केन्द्रीय सरकार द्वारा अभी तक कोई कदम ना उठाए जाने से हमें ऐसा लगता है कि हम अपनी बात सरकार के शीर्ष स्तर तक ठीक प्रकार से पहुँचाने में असमर्थ रहे हैं।

संगठन के हजारों कार्यकर्ताओं के 9 वर्षों से अधिक समय से जारी अनवरत प्रयासों के बावजूद राष्ट्रीय महत्व की इस समस्या की ओर अब तक सरकार का ध्यान आकर्षित कराने में असफल रहने पर हमने राष्ट्रव्यापी जनसंख्या अभियान के अपने अनुभव, भारत की जनगणना एवं अन्य स्रोतों से प्राप्त विभिन्न जनसांख्यिकीय आंकड़ों के अध्ययन और विश्लेषण तथा जनसांख्यिकीय असंतुलन के खतरों की भयावहता को लेकर संगठन के देशभर के कार्यकर्ताओं के माध्यम से प्राप्त आम जनमानस की धरातलीय फीडबैक के आधार पर एक पुस्तिका तैयार की है । पुस्तिका में दिए तथ्यों एवं निष्कर्षो को पढ़कर जनसांख्यिकीय असंतुलन के कारण भारत के पल-प्रतिपल गृहयुद्ध की ओर अग्रसर होने का स्पष्ट रूप से आभास हो जाता है। हमारा मानना है। कि इन सभी बिन्दुओं पर तार्किक रूप से विचार करके पुस्तिका में सुझाए ठोस कानूनी कदम उठाने से विभिन्न सामाजिक वर्गों के बीच जनसंख्या का अनुपात निश्चित रूप से हमेशा-हमेशा के लिए वर्तमान अनुपात के अनुसार बना रह सकता है।

जनसांख्यिकीय असंतुलन की विभीषिका पर तर्कों और तथ्यों के साथ प्रकाश डालती इस पुस्तिका को हमने भारत सरकार के शीर्ष नेतृत्व को आवश्यक विषयों पर सुझाव देने में सक्षम महत्वपूर्ण लोगों (हमारी समझ के अनुसार) तक विभिन्न माध्यमों से पहुँचाया है । परन्तु उनमें से कुछ तो राष्ट्र के समक्ष उपस्थित जनसांख्यिकीय असंतुलन के खतरों को ही नकारते दिख रहे हैं। भारत के इतिहास में ऐसे अनेक उदाहरण हैं जब बौद्धिक श्रेष्ठता भाव के कारण बड़े लोगों ने साधारण जन की ओर से आई राष्ट्रहित की महत्वपूर्ण बातों को भी नकारकर बड़ी गलतियां कीं, जिसकी कीमत समूचे राष्ट्र को पीढ़ियों तक चुकानी पड़ी। ईश्वर करें यह ऐतिहासिक अवधारणा वर्तमान परिप्रेक्ष्य में गलत साबित हो।

विगत 9 वर्षों से अधिक समय से संगठन द्वारा जारी जनसंख्या अभियान के अन्तर्गत देशभर के विभिन्न राज्यों के अधिकांश जिलों के अनेक शहरों, कस्बों और गांवों में अपने प्रवास के दौरान आम लोगों से संपर्क और इस विषय में उन सबकी राय जानकर हमें यह अहसास हो गया है कि जनसांख्यिकीय असंतुलन के खतरों को भांपकर उनमें एक अंडरकरंट चल रहा है। देश के एक बहुत बड़े वर्ग की यह चिंता सीधे अथवा हमारे अनेक प्रयासों के बावजूद भी सरकार तक ना
पहुँचने के कारण आशंका होने लगी है कि राष्ट्रीय महत्व के विषयों पर आम जनमानस के सुझावों को आप तक पहुँचाने वाले इन्फॉर्मेशन नेटवर्क में कहीं कोई गड़बड़ है वर्ना कोई कारण नहीं कि जनसांख्यिकीय असंतुलन के जिस खतरे को देश का बच्चा-बच्चा समझ रहा है, आप जैसे राष्ट्रभक्त नेतृत्व द्वारा उस पर अब तक कोई निर्णय ना ले लिया गया होता।

हमें ज्ञात है कि विगत 9 वर्षों में आपके नेतृत्व में भारत ने एक राष्ट्र के रूप में प्रत्येक क्षेत्र में उल्लेखनीय प्रगति की है और राष्ट्रीय एवं अंतर्राष्ट्रीय महत्व के अनेक विषयों पर ऐतिहासिक कार्य हुआ है। किसी राष्ट्र के लोगों को ऐसा नेतृत्व भाग्य से ही मिलता है, जिसे संजोकर रखने की जिम्मेदारी उस राष्ट्र के विवेकशील नागरिकों की होती है। परन्तु जागरूक नागरिक और एक राष्ट्रवादी संगठन के सदस्य होने के नाते हमारा यह कर्तव्य भी है कि हम जनसांख्यिकीय असंतुलन के कारण राष्ट्र के अस्तित्व पर मंडरा रहे संकट और आम जनमानस में इस विषय पर चल रहे अंडरकरंट से देश के शीर्ष नेतृत्व को अवगत कराकर इस विकट समस्या का समाधान कराने हेतु भरसक प्रयत्न करें।

लोकतांत्रिक व्यवस्था में राष्ट्रीय महत्व की बात शीर्ष नेतृत्व तक पहुँचाने के सभी रास्ते बंद दिखाई पड़ने पर सार्वजनिक प्रदर्शन ही एकमात्र विकल्प बचता है। विश्व जनसंख्या दिवस के अवसर पर आज 11 जुलाई 2023 को जिलाधिकारियों के माध्यम से ज्ञापन देकर आप तक अपनी बात पहुँचाने का प्रयास किया जा रहा है। 22 सितंबर 2023 को हस्ताक्षरित पत्रकों के साथ देशभर से आए कार्यकर्ताओं के दिल्ली-गाजियाबाद बॉर्डर के निकट संगठन के अस्थाई कैम्प पर एकत्रीकरण से पूर्व आपसे भेंट करने का अवसर मिलने पर हम एक प्रतिनिधिमंडल (आपके द्वारा निर्देशित संख्या) के रूप में इस विषय पर आपके समक्ष संगठन के 23 राज्यों के अपने प्रतिनिधियों द्वारा सुझाए गए बिन्दुओं के आधार पर प्रस्तुतिकरण देने का प्रयास करेंगे।

आम जनमानस से प्राप्त हस्ताक्षरित पत्रकों को लेकर 23 सितंबर 2023 को संगठन के अस्थाई कैम्प से प्रधानमंत्री कार्यालय, दिल्ली की ओर रैली के रूप हम इस अपेक्षा के साथ कूच करेंगे कि आप अथवा आपके द्वारा नियुक्त प्रतिनिधि इंडिया गेट के सामने के मैदान में देशभर से आए हमारे कार्यकर्ताओं से समर्थन पत्रक ग्रहण करके उनसे वार्ता करेंगे। चूंकि राष्ट्र के अस्तित्व को चुनौती दे रही जनसांख्यिकीय असंतुलन की समस्या का समाधान किया जाना हमारे सुविधाजनक जीवनयापन और यहां तक कि हमारे अपने प्राणों की कीमत से भी कहीं अधिक बड़ा है, इसलिए जनसंख्या नियंत्रण कानून बनने की प्रक्रिया प्रारम्भ करने की सहमति ना बनने की स्थिति में हम अंतिम विकल्प के रूप में शांतिपूर्ण और अनुशासित ढंग से परन्तु दृढ निश्चय के साथ धरने पर बैठ जाएंगे और कानून बनने की प्रक्रिया प्रारम्भ होने पर ही धरने का समापन करेंगे ।

आप जैसे क्षमतावान व राष्ट्रभक्त नेतृत्व से आग्रह है कि आप विश्व के मात्र 2.4% भू-भाग पर विश्व की कुल लगभग 800 करोड़ जनसंख्या के 17.8% अर्थात 142 करोड़ से अधिक आबादी का भार वहन कर रहे भारत की जनसंख्या विस्फोट और जनसांख्यिकीय असंतुलन की समस्या के समाधान के लिए अपनी ओर से पहल करके निम्न प्रावधानों से युक्त मसौदे पर
मंत्रिमंडल समूह में आवश्यक चर्चा कराकर जनसंख्या नियंत्रण कानून बनाने की प्रक्रिया 22 सितंबर 2023 से पूर्व ही प्रारम्भ करने की कृपा करें।

1. सरकार जनसंख्या के उचित समाधान के लिए ऐसा कानून बनाए जिसमें भ्रम की स्थिति ना रहे और जाति, धर्म, क्षेत्र व भाषायी बंधनों से ऊपर उठकर, राष्ट्रहित को सर्वोपरि मानते हुए यह कानून देश के सभी नागरिकों पर समान रूप से लागू हो

2. इस कानून के सभी दंडात्मक प्रावधान कानून अधिसूचित होने की तिथि के एक वर्ष के पश्चात कानून तोड़कर दूसरी जीवित संतान से अधिक बच्चे की उत्पत्ति करने वाले जैविक माता-पिता पर लागू हों। कानून बनने के पूर्व में उत्पन्न दो से अधिक संतानों के मामले में किसी भी नागरिक पर किसी भी रूप में यह कानून लागू नहीं होगा ।

3. जनसंख्या समाधान विषयक कानून अधिसूचित होने की तिथि के एक वर्ष के पश्चात कानून तोड़कर दूसरी से अधिक संतान उत्पन्न करने वाले दंपत्ति को सरकार द्वारा मिलने वाली सभी प्रकार की सहायता एवं अनुदान आदि समाप्त किए जाने का प्रावधान कानून में किया जाए।

4. वर्तमान में राजकीय सेवा में नियोजित, दो या दो से अधिक बच्चों वाले माता-पिता सरकार द्वारा कानून अधिसूचित होने की तिथि के एक वर्ष के पश्चात कानून तोड़कर अगली संतान की उत्पत्ति करने पर अपने पद पर नहीं बने रह सकें तथा भविष्य में नियोजित किए जाने की पात्रता भी समाप्त हो जाए, ऐसा प्रावधान कानून में किया जाए।

5. कानून अधिसूचित होने की तिथि के एक वर्ष के पश्चात कानून तोड़कर दूसरी से अधिक संतान उत्पन्न करने वाले जैविक माता-पिता व संतान को जीवन पर्यन्त मताधिकार एवं किसी भी प्रकार की चुनावी प्रक्रिया में भाग लेने से वंचित किया जाए।

6. कानून का एक बार उल्लंघन करने के बाद दोबारा उल्लंघन करने अर्थात चौथी संतान की उत्पत्ति की स्थिति में पिछले प्रावधानों के साथ-साथ ऐसे दंपत्ति (पति-पत्नी दोनों) की अनिवार्य नसबंदी करके उनको 10 वर्ष की जेल की सजा का प्रावधान किया जाए ताकि चौथी संतान के बारे में कोई नागरिक स्वप्न में भी ना सोच सके ।

7. दंपत्ति को प्रथम बार में जुड़वाँ संतान उत्पन्न होने की स्थिति में परिवार पूर्ण माना जाए और अगली संतान की उत्पत्ति कानून का उल्लंघन मानी जाए दूसरे बच्चे के समय जुड़वाँ संतान होना एक अपवाद मानकर ऐसी स्थिति में कानून प्रभावी ना हो ।

8. जाति, धर्म व संप्रदायों से ऊपर उठकर यह प्रावधान स्पष्ट रूप से रहे कि पहली शादी से दो जीवित संतानों के साथ तलाक होने की स्थिति में स्त्री या पुरुष में से कोई भी दूसरी शादी के बाद संतानोत्पत्ति के अधिकारी नहीं रहेंगे, भले ही दूसरे जीवनसाथी को पहले से अथवा पहली शादी से कोई संतान ना हो। अगर एक बच्चा हो तो केवल एक बच्चे की उत्पत्ति का अधिकार रहे।

9. बहुविवाह ( एक से अधिक पत्नी) एवं बहुपतित्व विवाहों के मामले में कहीं कोई भ्रम की स्थिति नहीं रहनी चाहिए। अगर कानूनन भी कोई पुरुष एक से अधिक पत्नी रखता है और उन्हें तलाक देकर अदल बदल करते हुए अपने जीवनकाल में अनेक शादियां करता है तो उसे सभी पत्नियों के माध्यम से अलग अलग दो-दो बच्चे पैदा करने की छूट नहीं दी जा सकती। किसी एक अथवा दो पत्नियों से कुल दो बच्चों की उत्पत्ति पर (पत्नियों अथवा पतियों की संख्या जो भी हो) परिवार पूर्ण माना जाए। कुल मिलाकर पत्नियों अथवा पतियों की संख्या कितनी भी क्यों ना हो, उसे एक परिवार मानते हुए बच्चों की कुल संख्या 2 से अधिक होना कानून का उल्लंघन माना जाए।

10. पूर्वोत्तर भारत के राज्यों असम, सिक्किम, अरुणाचल प्रदेश, नागालैंड, मिजोरम, मणिपुर, – मेघालय एवं त्रिपुरा की मूल धार्मिक जनजातियों की जनसंख्या अवैध घुसपैठ के कारण अनुपातिक रूप से घटते जाने के कारण कुछ निश्चित समय के लिए वहां की मूल धार्मिक जनजातियों को जनसंख्या नियंत्रण कानून की परिधि से बाहर रखा जाए। अवैध घुसपैठ के पश्चात स्थानीय लड़कियों से शादी करके वहीं बस जाने वाले किसी भी बाहरी व्यक्ति / घुसपैठियों को किसी प्रकार की छूट नहीं मिलनी चाहिए ।

11. उपरोक्त प्रावधानों के क्रियान्वयन हेतु आवश्यक होने पर संविधान में उपयुक्त संशोधन किया जाए।

22वें विधि आयोग ने देश के विभिन्न कानूनों के क्रियान्वयन में एकरूपता लाने के उद्देश्य से प्रत्येक नागरिक के लिए समान नागरिक संहिता लागू करने के संबंध में आम लोगों और धार्मिक समूहों से राय मांगी है। आपसे आग्रह है कि जनसंख्या नियंत्रण कानून के विभिन्न दंडात्मक प्रावधान भले ही अलग कानून के रूप में निरूपित किये जाएं, परन्तु इन्हें देश के सभी नागरिकों पर समान रूप से लागू करने के लिए प्रस्तावित “यूनिफॉर्म सिविल कोड” में समायोजित करने हेतु विधि आयोग को निर्देशित करने की कृपा करें।

जनसांख्यिकीय असंतुलन पर कुशल एवं प्रभावी नियंत्रण भारत ही नहीं अपितु संपूर्ण विश्व और समूची मानवता के लिए अत्यन्त आवश्यक है।

Subject: Regarding the implementation of population control law without delay to solve the challenges arising before the nation of India due to population explosion and demographic imbalance.

Respected sir,
People across the country, who wish to keep India’s culture and integrity intact, are extremely concerned about the class imbalance in the population. It is widely believed that despite the so-called decline in the total fertility rate (TFR) in a country formerly divided on religious lines, the continuing deterioration of the social balance between different sections of the population is an alarming situation. This imbalance can prove extremely disastrous for the fabric of the country in the future.

For more than 9 years, thousands of small and big gatherings, big- Big rallies, padayatras and rathyatras have been organized. Every year, on World Population Day and other occasions, memorandums have been handed over to the Honorable Prime Minister through the District Magistrates by the organization workers of most of the districts of the country, meeting the Honorable President, giving a presentation on the subject and including MP-dialogue programs. Currently, the organization is running a signature campaign across the country with the aim of getting the support of common people on the above law.

You are probably facing the problem of demographic imbalance due to your continuous efforts to solve the many challenges facing the nation and to achieve the goal of making India safe, prosperous and prosperous for all citizens and because of your busyness in other important works of national importance. And are not paying that much attention, otherwise concrete steps would have been taken by you to solve this serious problem which has divided the country in the past and is warning of the possibility of it happening again in the future.

On getting an opportunity to meet you before gathering at the organization’s temporary camp near Ghaziabad border, we as a delegation (number specified by you) will present before you on this subject on the basis of the points suggested by our representatives of 23 states of the organization Will try to give a presentation.

Taking the signed leaflets received from the general public, we will march from the temporary camp of the organization to the Prime Minister’s Office, Delhi on 23 September 2023 as a rally with the expectation that you or your appointed representative will come from all over the country to the ground in front of India Gate. Will hold talks with our workers after receiving the letter of support. Since the problem of demographic imbalance challenging the very existence of the nation to be resolved is much bigger than the cost of our comfortable living and even our own lives, the situation of not agreeing to start the process of making population control law As a last resort, we will sit on dharna in a peaceful and disciplined manner but with firm determination and will end the dharna only after the law making process begins.

Capable and patriotic leadership like you are requested to solve the problem of population explosion and demographic imbalance of India, which is carrying the burden of 17.8% of the world’s total population of about 800 crores i.e. more than 142 crores on only 2.4% of the world’s land area. On its own initiative for the resolution of
Kindly start the process of making population control law before 22 September 2023 by holding necessary discussions in the cabinet group.

1. The government should make such a law for the proper solution of the population, in which there is no confusion and rising above caste, religion, region and linguistic restrictions, considering the national interest as paramount, this law should apply equally to all the citizens of the country.

2. All the penal provisions of this law should be applicable to biological parents who break the law after one year from the date of notification of the law and have more than one living child. In the case of more than two children born before the enactment of any

This law will not apply to the citizen in any form.

3. A provision should be made in the law to abolish all kinds of assistance and grants etc. given by the government to couples who break the law and produce more than one child after one year from the date of notification of the law on population solution.

4. At present employed in government service, parents having two or more children cannot continue in their post after breaking the law after one year from the date of notification of the law by giving birth to the next child and employed in future. If the eligibility to be done also ends, such a provision should be made in the law.

5. After one year from the date of notification of the law, biological parents and children who break the law and produce more than one child should be deprived of voting rights and participation in any kind of election process for life.

6. Provision should be made for 10 years of jail term for such couple (both husband and wife) by compulsory sterilisation, along with previous provisions, in case of second violation i.e. birth of fourth child after violating the law once. So that no citizen can think about the fourth child even in his dreams.

7. The couple should be considered complete in the event of the birth of twin children for the first time, and the birth of the next child should be considered a violation of the law, considering the presence of twin children at the time of the second child as an exception, the law should not be effective in such a situation.

8. Irrespective of caste, religion and creed, this provision should be clear that in case of divorce with two living children from the first marriage, neither of the men or women will be entitled to procreate after the second marriage, even if the other Spouse should not have any child from before or from first marriage. If there is a child, then only one child has the right of birth.

9. There should not be any confusion in the matter of polygamy (more than one wife) and polyandry marriages. Even legally, if a man keeps more than one wife and after divorcing them, alternately marries several times during his lifetime, then he should have two children each through all the wives separately.

Procreation cannot be allowed. On the birth of total two children from one or two wives (whatever may be the number of wives or husbands), the family should be considered complete. Irrespective of the number of wives or husbands in total, considering it as a family, the total number of children being more than 2 should be considered as a violation of the law.

10. As the population of the indigenous religious tribes of North-Eastern India states Assam, Sikkim, Arunachal Pradesh, Nagaland, Mizoram, Manipur, Meghalaya and Tripura is decreasing proportionately due to illegal infiltration, the indigenous religious tribes there for a certain period of time. be kept out of the purview of the population control law. No exemption should be given to any outsider/infiltrator who marries local girls after illegal infiltration and settles there.

11. Suitable amendment should be made in the constitution if necessary for the implementation of the above provisions.

The 22nd Law Commission has sought views from the general public and religious groups regarding the implementation of a Uniform Civil Code for every citizen with a view to bringing uniformity in the implementation of various laws in the country. You are requested to direct the Law Commission to adjust the various penal provisions of the Population Control Act in the proposed “Uniform Civil Code” to apply them equally to all the citizens of the country, even though they may be formulated as separate laws. Please do

Efficient and effective control of demographic imbalance is very necessary not only for India but for the whole world and the entire humanity.
