The Kerala Story: ‘जब पूरे देश में फिल्म दिखाई जा रही है तो बंगाल में ही बैन क्यों’, ममता सरकार से ‘सुप्रीम’ सवाल
सुप्रीम कोर्ट ने द केरला स्टोरी फिल्म पर पश्चिम बंगाल सरकार की ओर से लगाए गए बैन पर सवाल खड़े किए हैं. चीफ जस्टिस ने कहा कि जब देश के दूसरे हिस्सों में ये फिल्म दिखाई जा रही है तो फिर बंगाल में फिल्म पर रोक का क्या मतलब है. पश्चिम बंगाल भी देश के दूसरे हिस्सों की ही तरह है.
सुप्रीम कोर्ट ने यह टिप्पणी फिल्म निर्माता की उस अर्जी पर सुनवाई के दौरान की जिसमें उन्होंने पश्चिम बंगाल और तमिलनाडु में फिल्म पर लगी रोक को चुनौती दी थी.

शुक्रवार को सन शाइन प्रोडक्शन की ओर से वरिष्ठ वकील हरीश साल्वे पेश हुए. उन्होंने कहा कि जब इस फिल्म को रिलीज किया गया तो पहले ही दिन सूबे की मुख्यमंत्री ने बयान दिया कि यह फिल्म एक समुदाय विशेष के खिलाफ है और इसके प्रदर्शन से राज्य में कानून-व्यवस्था बिगड़ सकती है. रिलीज के तीन दिन बाद बिना इस तरह दिक्कत के ही राज्य सरकार ने फिल्म पर बैन का आदेश जारी कर दिया.
साल्वे ने कहा कि तमिलनाडु में जिस तरीके से थिएटर मालिकों को धमकाया जा रहा है, उसके मद्देनजर सिनेमाघर मालिकों ने इस फिल्म को वापस ले लिया है.
बंगाल ने कानून-व्यवस्था का दिया हवाला
पश्चिम बंगाल सरकार की ओर से वरिष्ठ वकील अभिषेक मनु सिंघवी पेश हुए. उन्होंने दलील दी कि इससे जुड़ी दूसरी याचिकाओं को भी सुप्रीम कोर्ट ने हाई कोर्ट में सुनवाई के लिए भेजा था. इस याचिका पर भी हाईकोर्ट को ही सुनवाई के लिए भेजा जाना चाहिए. सिंघवी ने कहा कि इस तरह की खुफिया रिपोर्ट मिली थी कि फिल्म की रिलीज जारी रहने से कानून-व्यवस्था की स्थिति बिगड़ सकती है और समुदायों में वैमनस्य पैदा हो सकता है.
SC का बंगाल सरकार से सवाल
इस पर चीफ जस्टिस डी वाई चंद्रचूड़ ने कहा, ‘ये फिल्म देश के दूसरे देशों में भी रिलीज हुई है.पश्चिम बंगाल देश के दूसरे हिस्सों से अलग नहीं है.अगर दूसरे हिस्सों में फिल्म देखी जा सकती है , जहां की डेमोग्राफिक प्रोफाइल पश्चिम बंगाल सरकार जैसी ही है तो फिर यहां रिलीज पर रोक लगाने का कोई मतलब नहीं है. आप फिल्म को चलने की इजाजत क्यों नहीं दे रहे? सवाल फिल्म के अच्छे-बुरे का नहीं है, अगर लोगों को फिल्म पसंद नहीं आएगी तो वो नहीं देखेंगे.’

बंगाल-तमिलनाडु से जवाब मांगा
सिंघवी ने जवाब दिया कि वेस्ट बंगाल सिनेमा रेगुलेशन एक्ट 1954 के तहत मिले अधिकार का इस्तेमाल करते हुए और खुफिया रिपोर्ट के आधार पर सरकार ने ये बैन लगाया है और कोर्ट को राज्य सरकार के आदेश पर ऐसे स्टे नहीं लगाना चाहिए. चीफ जस्टिस ने साफ किया कि बिना राज्यों का पक्ष सुने हम कोई आदेश पास नहीं कर रहे. कोर्ट ने पश्चिम बंगाल और तमिलनाडु सरकार को नोटिस जारी किया है.
‘तमिलनाडु सरकार सिनेमाघरों को सुरक्षा दे’
सुप्रीम कोर्ट ने तमिलनाडु सरकार को भी सिनेमाघरों की सुरक्षा सुनिश्चित करने को कहा. कोर्ट ने तमिलनाडु सरकार की ओर से पेश वकील से कहा कि ये क़ानून व्यवस्था का मसला है. जब थियेटर पर हमले हो रहे हो, कुर्सियों को जलाया रहा हो.तो आप उसे नजरअंदाज नहीं कर सकते. आप थियेटरों की सुरक्षा सुनिश्चित कीजिए और हलफनामा दाखिल कर बताइए कि आपने क्या कदम उठाए हैं.

The Supreme Court has questioned the ban imposed by the West Bengal government on the film The Kerala Story. The Chief Justice said that when this film is being shown in other parts of the country, then what is the meaning of banning the film in Bengal. West Bengal is also like other parts of the country.
The Supreme Court made this comment during the hearing of the film producer’s application in which he challenged the ban on the film in West Bengal and Tamil Nadu.
On Friday, senior advocate Harish Salve appeared on behalf of Sun Shine Production. He said that when the film was released, the Chief Minister of the state made a statement on the very first day that the film was against a particular community and its release could lead to law and order problems in the state. Three days after the release, without any such problem, the state government issued a ban order on the film.
Salve said that in view of the way theater owners are being threatened in Tamil Nadu, the theater owners have withdrawn the film.
Bengal cited law and order
Senior advocate Abhishek Manu Singhvi appeared on behalf of the Government of West Bengal. He argued that other petitions related to this had also been sent by the Supreme Court for hearing in the High Court. This petition should also be sent to the High Court for hearing. Singhvi said that there were intelligence reports that the continuation of the film’s release could lead to law and order situation and disharmony among communities.
SC’s question to Bengal government
On this, Chief Justice DY Chandrachud said, ‘This film has been released in other countries of the country as well. West Bengal is no different from other parts of the country. If the film can be seen in other parts, where the demographic profile of West Bengal If the government is like this, then there is no point in banning the release here. Why are you not allowing the film to run? The question is not about the good or bad of the film, if people do not like the film then they will not watch it.
Answer sought from Bengal-Tamil Nadu
Singhvi replied that the government has imposed this ban using the authority given under the West Bengal Cinema Regulation Act 1954 and on the basis of intelligence reports and the court should not impose such a stay on the orders of the state government. The Chief Justice made it clear that we are not passing any order without listening to the states. The court has issued notices to the West Bengal and Tamil Nadu governments.
‘Tamil Nadu government should give security to cinema halls’
The Supreme Court also asked the Tamil Nadu government to ensure the security of cinema halls. The court told the lawyer appearing for the Tamil Nadu government that it is a matter of law and order. When theaters are being attacked, chairs are being burnt, you cannot ignore it. You ensure the security of theaters and file an affidavit telling what steps you have taken.
