*IPC और CrPc की जगह लेंगे नए कानून, अगले हफ्ते संसद में पेश होंगे नए बिल*
नई दिल्ली :* केंद्र सरकार ने भारतीय दंड संहिता (IPC) और भारतीय दंड प्रक्रिया संहिता ( CrPC) और एविडेंस एक्ट में बदलाव के लिए तीन नए बिलों को मंजूरी दे दी है. तीन नए बिलों को अगले हफ्ते संसद में पेश किया जाएगा. गृह मंत्री अमित शाह ने 11 अगस्त 163 साल पुराने 3 मूलभूत कानूनों में बदलाव के बिल लोकसभा में पेश किए थे. ये बिल इंडियन पीनल कोड (IPC), कोड ऑफ क्रिमिनल प्रोसिजर (CrPC) और एविडेंस एक्ट हैं. सबसे बड़ा बदलाव राजद्रोह कानून को लेकर है, जिसे नए स्वरूप में लाया जाएगा. संसद से नए बिलों के पास होने के बाद कई धाराएं और प्रावधान बदल जाएंगे.
इंडियन पीनल कोड (IPC) का नया नाम भारतीय न्याय संहिता होगा. क्रिमिनल प्रोसीजर कोड (CrPC) का नया नाम भारतीय नागरिक सुरक्षा संहिता होगा. इसके साथ ही इंडियन एविडेंस एक्ट का नाम भारतीय साक्ष्य अधिनियम होगा. यहां पर गौर करने वाली बात है कि इन कानूनों का अंग्रेजी में भी यही नाम होगा
*IPC क्या है?*
सिविल लॉ और क्रिमिनल भी IPC यानी भारतीय दंड संहिता के तहत आते हैं. गंभीर अपराधों के मामले में आईपीसी की धाराएं लगाई जाती हैं. IPC भारतीय नागरिकों के अपराधों की परिभाषा के साथ उसके लिए तय दंड को बताती है. इसमें 23 चैप्टर हैं और 511 धाराएं हैं. इसकी धाराएं भारतीय सेना पर लागू नहीं होती.
*कितना अलग है CrPC?*
आमतौर पर थानों में मामले आईपीसी की धाराओं के तहत दर्ज होते है, लेकिन इनकी जांच की प्रक्रिया में CrPC का इस्तेमाल किया जाता है. इसका पूरा नाम है- कोड ऑफ क्रिमिनल प्रोसिजर आसान भाषा में समझें तो पुलिस अपराधिक मामलों को आईपीसी के तहत दर्ज करती है, लेकिन उसके बाद की प्रक्रिया सीआरपीसी के तहत चलती है. इसे उदाहरण से समझ सकते हैं.
सरकार की ओर से कहा गया कि 18 राज्यों, 6 केंद्र शासित प्रदेशों, सुप्रीम कोर्ट, 22 हाई कोर्ट, न्यायिक संस्थाओं, 142 सांसदों और 270 विधायकों के अलावा जनता ने भी इन विधेयकों को लेकर सुझाव दिए हैं. चार साल की चर्चा और इस दौरान 158 बैठकों के बाद सरकार ने बिल को अगस्त में पेश किया था. इन बदलावों के लिए पहली बैठक सितंबर 2019 में संसद भवन के पुस्तकालाय के रूम नंबर जी-74 में हुई थी.
New Delhi:* The Central Government has approved three new bills for changes in the Indian Penal Code (IPC), Indian Criminal Procedure Code (CrPC) and Evidence Act. Three new bills will be presented in Parliament next week. On August 11, Home Minister Amit Shah had introduced bills to amend three 163-year-old fundamental laws in the Lok Sabha. These bills are Indian Penal Code (IPC), Code of Criminal Procedure (CrPC) and Evidence Act. The biggest change is regarding the treason law, which will be brought in a new form. After the new bills are passed by the Parliament, many sections and provisions will change.
The new name of the Indian Penal Code (IPC) will be the Indian Judicial Code. The new name of the Criminal Procedure Code (CrPC) will be the Indian Civil Protection Code. With this, the name of Indian Evidence Act will be Indian Evidence Act. It is worth noting here that these laws will have the same name in English also.
*What is IPC?*
Civil law and criminal also come under IPC i.e. Indian Penal Code. IPC sections are imposed in case of serious crimes. IPC defines the crimes of Indian citizens along with the punishment prescribed for them. It has 23 chapters and 511 sections. Its sections do not apply to the Indian Army.
*How different is CrPC?*
Generally, cases are registered in police stations under IPC sections, but CrPC is used in the process of investigation. Its full name is – Code of Criminal Procedure. If you understand in simple language, the police register criminal cases under IPC, but the process after that goes on under CrPC. This can be understood with an example.
On behalf of the government, it was said that apart from 18 states, 6 union territories, Supreme Court, 22 High Courts, judicial institutions, 142 MPs and 270 MLAs, the public has also given suggestions regarding these bills. After four years of discussion and 158 meetings during this period, the government introduced the bill in August. The first meeting for these changes was held in September 2019 in room number G-74 of the Library of Parliament House.
